“Lifeworks” refers to Lifeworks Consulting Sdn Bhd and its Learning Management System, www.menimba.com, its subdomain or any other URL designated by Lifeworks to Instructor.
“Lifeworks Learning Management System” refers to all the web-based inbound marketing and sales applications, tools, and platforms developed, operated, maintained, and managed by Lifeworks.
“Instructor” refers to the non- Lifeworks Party and/ or Parties and content creators who enters an agreement with Lifeworks to create free and/ or paid Course(s).
“Learner” refers to the authorized user of Lifeworks who shall be enrolled in the educational programs of Instructor.
“Course(s)” refers to the content’s consisting of the educational program submitted and/ or uploaded by Instructor including but not limited to lessons, quizzes, exercise, assignments, resources, answers, course landing page, announcements, data, text, messages, sound, music, video, photographs, graphics, images, tags, etc.
User Account
Learner needs a user account to access and enrol the online Course(s) in Lifeworks. When setting up and maintaining the Learner account, Learner must provide and continue to provide accurate and complete information, including a valid email address. Learner are responsible for what happens with Learner’s account, including for any harm or damages (to Lifeworks or anyone else) caused by someone using Learner’s account without Learner’s permission. This means Learner need to be careful with Learner’s password. Learner may not transfer the account to someone else or use someone else’s account. If you contact Lifeworks to request access to an account, we will not grant Learner such access unless Learner can provide us with the information that we need to prove Learner are the owner of that account. In the event of the death of a Learner, the account of that Learner will be closed.
Lifeworks will not intervene in disputes between Learner or Instructor who have shared account login credentials. Instructor and/or Learner must notify Lifeworks immediately upon learning that someone else may be using Instructor and/or Learner account without Instructor and/or Learner permission (or if you suspect any other breach of security) by contacting Lifeworks. Lifeworks may request some information from Instructor and/or Learner to confirm that Instructor and/or Learner are indeed the owner of Instructor and/or Learner account.
Your Commitment Towards The Course(s)
Demands of a Learner’s Course(s) – The Course(s) which Learner are about to begin will be an exciting journey. It will allow Learner to explore the techniques and methodology for each Course(s) that Leaner’s choose.
Learner’s attendance –Important information is included in every lesson. Course(s) are built from a few basics to more complex concepts, Learner must read and view all materials, or Learner’s online Course(s) will be incomplete. Learner will need to complete the Course(s) in order to receive a certificate of completion.
Learner study material –Course(s) will contain materials such as reading materials, videos and instructional presentation of the academic content. Everything Learner need to pre-study or review the academic material, is contained in the system. Some Course(s) involve pre-studying the materials and homework. Learner are required to complete it beforehand.
Course(s) Duration – Course(s) duration may vary for different Course(s). Upon enrolment, it is important to get started right away and to keep on schedule for successful completion of the Course(s). A reminder that the Course(s) is expired will be sent via email to notify Learner.
Course(s) Enrolment
As a Learner, when you enrol in a Course(s), whether it’s a free or paid, Learner are getting permission from Lifeworks to view the Course(s) via the Lifeworks, and Lifeworks is the licensor of record. Course(s) are licensed, and not sold, to Learner. This permission does not give Learner any right to resell the Course(s) in any manner (including by sharing account information with a purchaser or illegally downloading the Course(s) and sharing it on torrent sites or the cloud).
Lifeworks grants Learner a limited, non-exclusive, non-transferable license to access and view the Course(s) and associated content for which Learner have paid all required fees, solely for Learner’s personal, non-commercial, educational purposes through Lifeworks, in accordance with these Terms and Conditions or restrictions associated with a particular Course(s) or feature of Lifeworks. All other uses are expressly prohibited. Learner may not reproduce, redistribute, transmit, assign, sell, broadcast, rent, share, lend, modify, adapt, edit, create derivative works of, sublicense, or otherwise transfer or use any Course(s) unless we give Learner explicit permission to do so in a written agreement signed by a Lifeworks authorized representative. Lifeworks reserve the right to revoke permission to access and use Course(s) at any point in time in the event where we decide or are obligated to disable access to a Course(s) due to legal or policy reasons.
Course(s) Payments
Pricing
The price of Course(s) provided by Lifeworks are determined based on the price offered by our partnership agreements with Instructor, as state in the Lifeworks Instructor Agreement. Lifeworks regularly run promotions and sales for our Course(s) and certain Course(s) are only available at discounted prices for a set period of time. The price applicable to a Course(s) will be the price at the time you complete your purchase of the Course(s) (at checkout). Enrolment will only begin when Lifeworks receive payments in our bank account or other third-party payment processing accounts (PayPal, TransferWise, etc.)
The fee includes:
- Course(s) Registration Fee
- Usage of Lifeworks Learning Management System (Menimba)
- Study Materials:
- Video Presentation
- Reading Materials
- Virtual Session(s)
Payment
Learner agree to pay the fees for Course(s) that Learner purchase, and Learner authorize Lifeworks to charge your debit or credit card or process other means of payment (such as PayPal, TransferWise, direct debit/online banking, credit/debit card or mobile wallet, bank transfer) for those fees. Lifeworks works with third party payment processing partners to offer Learner the most convenient payment methods in Learner’s country and to keep Learner’s payment information secure.
When Learner make a purchase, Learner agree not to use an invalid or unauthorized payment method. Lifeworks reserve the right to disable access to any Course(s) for which we have not received adequate payment.
Charge any Conversion or Third-Party Fees
Lifeworks charges currency conversion fees when Learner purchase a Course(s). If Learner purchase a Course(s) in a currency that’s different from Learner’s payment method’s currency, however, Learner provider or third-party payment processor may apply a currency conversion rate or fees. Please contact your payment provider or bank for information on what fees may apply.

Using Lifeworks at Your Own Risk
Lifeworks do not review or edit the Course(s) created by Instructor for legal issues, and Lifeworks is not in a position to determine the legality of Course(s) content. Lifeworks do not exercise any editorial control over the Course(s) that are available on the Lifeworks Learning Management System and, as such, do not guarantee in any manner the reliability, validity, accuracy, or truthfulness of the Course(s). If Learner enrol in a Course(s), Learner rely on any information provided by Instructor at your own risk.
By using Lifeworks, Learner may be exposed to content that Learner consider offensive, indecent, or objectionable. Lifeworks has no responsibility to keep such content from Learner and no liability for your access or enrolment in any Course(s), to the extent permissible under applicable law. This also applies to any Course(s) relating to health, wellness, and physical exercise. Learner assume full responsibility for the choices Learner’s make before, during, and after Learner’s enrolment in a Course(s).
When Learner interact directly with other Learner or Instructor, Learner must be careful about the types of personal information that Learner’s share. While Lifeworks restrict the types of information Instructor may request from Learners, we do not control what Learner and Instructor do with the information they obtain from other Learners on the Lifeworks Learning Management System. Learner and/or Instructor should not share Learner and/or Instructor email or other personal information about Learner and/or Instructor for Learner and/or Instructor own safety.
Lifeworks do not hire or employ Instructor nor are we responsible or liable for any interactions involved between Instructor and Learner. Lifeworks are not liable for disputes, claims, losses, injuries, or damage of any kind that might arise out of or relate to the conduct of Instructor or Learner.
When Learner and/or Instructor use Lifeworks, Learner and/or Instructor will find links to other websites that Lifeworks don’t own or control. Lifeworks are not responsible for the content or any other aspect of these third-party sites, including their collection of information about you. Learner and/or Instructor should also read their Terms and Conditions and Privacy Policies.
Rights of Lifeworks
All rights, title, and interest in and to the Lifeworks Learning Management System, including our website, our existing or future applications, databases, and the content our employees or partners submit or provide through Lifeworks (but excluding content provided by Instructor) are and will remain the exclusive property of Lifeworks and its licensors. Lifeworks are protected by copyright, trademark, and other laws of both the Malaysia Laws and foreign countries. Nothing gives you a right to use the Lifeworks name or any of the Lifeworks’s trademarks, logos, domain names, and other distinctive brand features without prior written consent from Lifeworks. Any feedback, comments, or suggestions you may provide regarding Lifeworks or the services is entirely voluntary and we will be free to use such feedback, comments, or suggestions as we see fit and without any obligation to Learner and/or Instructor.
Learner and/or Instructor may not do any of the following while accessing or using the Lifeworks Learning Management System:
- Access, tamper with, or use non-public areas of the Lifeworks Learning Management System (including content storage), Lifeworks’s computer systems, or the technical delivery systems of Lifeworks’s service providers.
- Disable, interfere with, or try to circumvent any of the features of the Lifeworks Learning Management System related to security or probe, scan, or test the vulnerability of any of our systems.
- Copy, modify, create a derivative work of, reverse engineer, reverse assemble, or otherwise attempt to discover any source code of or content on the Lifeworks Learning Management System.
- Attempt to access or search our Lifeworks Learning Management System by any means (automated or otherwise) other than through our currently available search functionalities that are provided via our website, or mobile apps. Learner and/or Instructor may not scrape, spider, use a robot, or use other automated means of any kind to access the Services.
- In any way use Lifeworks to send altered, deceptive, or false source-identifying information (such as sending email communications falsely appearing as Lifeworks and/ or Menimba); or interfere with, or disrupt, (or attempt to do so), the access of any user, host, or network, including, without limitation, sending a virus, overloading, flooding, spamming, or mail-bombing the Lifeworks Learning Management System or services, or in any other manner interfering with or creating an undue burden on Lifeworks.
Updating These Terms
From time to time, Lifeworks may update these Terms & Conditions to clarify our practices or to reflect new or different practices (such as when we add new features), and Lifeworks reserves the right in its sole discretion to modify and/or make changes to these Terms & Conditions at any time. If we make any material change, we will notify you using prominent means, such as by email notice sent to the email address specified in your account or by posting a notice through Lifeworks. Modifications will become effective on the day they are posted unless stated otherwise.
Learner and/or Instructor continued use of our Services after changes become effective shall mean that Learner and/or Instructor accept those changes. Any revised Terms shall supersede all previous Terms.
Statement of Understanding
Learner understand and agree that by enrolling in the online Course(s), Learner are incurring obligations to complete the Course(s), mastering the subject matter for the field training sessions and skills are largely dependent on yourself. Learner also understand and agree that learning requires a commitment of time, money, cooperation and practice in order to be certified. Also, Learner understand that only after completion of the online Course(s), would you be awarded certification.
